Sažetak | Radno vrijeme, odmori i dopusti su važan dio prava radnika koji su regulirani Ustavom Republike Hrvatske, Zakonom o radu, drugim zakonskim i podzakonskim propisima, međunarodnim i europskim propisima, ali i kolektivnim ugovorima, internim aktima pravnih osoba i ugovorima o radu. Cilj ovog rada je istražiti pojam radnog vremena, odmora i dopusta na temelju Zakona u radu Republike Hrvatske i povijesni kontekst koji je doveo do današnjih prava radnika. Prilikom istraživanja povijesti radnog vremena je bilo potrebno izaći izvan granica Hrvatske i popratiti povijesna zbivanja u Europi i svijetu. Ovaj rad istražuje puno radno vrijeme, nepuno radno vrijeme, skraćeno radno vrijeme, prekovremeni rad, raspored radnog vremena, preraspodjelu radnog vremena, noćni rad, rad u smjenama, mogućnost drukčijeg uređenja radnog vremena, noćnog rada i odmora, upravne mjere i prekršajne odredbe. Iako su radno vrijeme i odmori dvije suprotne kategorije koje se međusobno isključuju, prilikom organizacije i rasporeda radnog vremena one međusobno utječu jedna na drugu pa su u radu obrađeni i odmori i dopusti. Odmori pripadaju u zaštitnu kategoriju prava radnika i dijele se na stanku, dnevni odmor, tjedni odmor i godišnji odmor, dok se dopusti dijele na plaćeni i neplaćeni dopust. Na kraju rada je napravljena usporedba primjene sva tri navedena instituta radnog prava u društvu MZLZ – Upravitelj zračne luke Zagreb d.o.o. Za obradu ove teme korištena je brojna literatura, međunarodni i nacionalni zakonski propisi te interni akti MZLZ – Upravitelj zračne luke Zagreb d. o. o. |
Sažetak (engleski) | Working hours, rests and leaves are an important part of employees' rights regulated by the Constitution of the Republic of Croatia, the Labour Act, other laws and regulations, international and European regulations, but also collective bargaining agreements, internal acts of legal entities and employment contracts. The aim of this paper is to explore the concept of working hours, rests and leaves on the basis of the Labour Act of the Republic of Croatia and the historical context that led to today's employees' rights. When researching the history of working hours, it was necessary to go beyond the borders of Croatia and follow historical events in Europe and the world. This paper explores full-time, part-time, part-time work, overtime, schedule of working hours, redistribution of working hours, night work, shift work, the possibility of a different arrangement of working hours, night works and rest, administrative measures, and misdemeanour provisions. Although working hours and rests are two opposite categories that are mutually exclusive, when organizing and scheduling working hours, they mutually influence each other, so rests and leaves are also covered in this paper. Rests belong to the protective category of employees' rights and are divided into breaks, daily rest, weekly rest, and annual leave, while leave is divided into paid and unpaid leave. At the end of this paper, a comparison of the application of all three mentioned institutes of Labour law in the company MZLZ - Zagreb Airport Operator Ltd. numerous literature, international and national legal regulations and internal acts of the MZLZ - Zagreb Airport Operator Ltd. were used to address this topic. |
