Abstract Javna nabava ključni je element javnih ulaganja kojim se potiče gospodarski rast. Prilikom provođenja postupaka javne nabave treba uzeti u obzir sva primjenjiva pravila o javnoj nabavi kojima se osiguravaju vrijednost za novac i pravedno tržišno natjecanje. Ispravnom i dosljednom primjenom pravila javne nabave ostvaruje se korist u smislu učinkovitosti i djelotvornosti za sve. Pojam javne nabave predstavlja skup propisa i pravila koja se odnose na nabavu usluga, roba i radova od strane javnih i sektorskih naručitelja na način koji osigurava ekonomično, učinkovito i gospodarski opravdano trošenje te nadzor proračunskih sredstava. Provođenjem postupaka javne nabave država osigurava obavljanje gotovo svih svojih javnih funkcija, nabavljajući dobra, radove i usluge od važnosti za svoje djelovanje Usklađenost zakonodavnog okvira u području javne nabave u Republici Hrvatskoj s pravnom stečevinom EU od izuzetnog je značenja ne samo zbog potrebe da postupci javne nabave, koji predstavljaju vrlo stručne i složene postupke , budu zakoniti, sukladni načelima javne nabave, te u tom smislu transparentni, učinkoviti, da omogućuju jednak tretman svih gospodarskih subjekata već, sukladno tome, i zbog činjenice da se ista pravila javne nabave primjenjuju u slučaju provedbe projekata financiranih iz europskih strukturnih i investicijskih fondova. Europski fondovi financijski su instrumenti koji osiguravaju provedbu pojedine javne politike Europske unije u zemljama članicama. To je novac europskih građana koji se, sukladno određenim pravilima i procedurama, dodjeljuje raznim korisnicima za provedbu projekata kojima se postižu ključne javne politike EU. Sukladno potrebama i potpisanom ugovoru za financiranje projekta, korisnici bespovratnih sredstava Europske unije trebaju prilagoditi obrasce i dokumente kojima će se koristiti u postupcima nabave usluga, roba ili radova, te provesti i isplanirati niz koraka kako bi se osigurala načela javne nabave. Prilikom planiranja nabava koje će biti sufinancirane bespovratnim sredstvima Europske unije potrebno je uzeti u obzir cjelokupni vremenski okvir trajanja postupaka javne nabave, od pripreme dokumentacije do same isporuke predmeta nabave. Također, potrebno je i uračunati vrijeme potrebno za procesuiranje eventualne izjavljene žalbe.
Abstract (english) Public procurement presents a key element of public investments for supporting economic growth. While conducting a public procurement process, it is important to consider all the rules and regulations that ensure best value for the money and guarantee fair competition. Correct and consistent application of public procurement rules and regulations ensures efficiency of the process and benefits all included parties. The term public procurement represents a collection of rules and regulations for acquiring goods and services by contracting authorities or entities in a way that ensures economical, efficient, and financially justified spending and supervision of budget resources. By conducting public procurements, government is able to provide almost all of its public services by acquiring goods and services essential for its existence. Compliance of public procurement in Croatia with legislative framework of European union is of uttermost importance, not only because of the need for legality, transparency and principle compliance of public procurement processes, which represent very technical and complex procedures, but also because of the fact that rules and regulations of public procurement apply when conducting projects financed by European structural and investment funds. European funds are financial instruments for implementing various public policies of European union in member states. These funds, belonging to European citizens, are granted according to certain rules and procedures to various users for conducting projects that accomplish key public policies of the EU. Pursuant to needs and signed agreement for financing the project, EU grant users must modify forms and files used in procurement of goods and services and plan and conduct series of steps for ensuring principles of public procurement are met. When planning procurements co-financed with EU grants, it is important to consider the complete timeframe of the procurement process, from preparing the documentation to delivering object of the procurement and take into account the time needed for processing possible complaints.
