Abstract
Ovaj rad bavi se autorskim djelima stvorenim u radnom odnosu te je posebice fokusiran na istraživanje i analizu postojećih zakona u Republici Hrvatskoj povezanih s navedenom temom. Svrha ovoga rada je sažeto prikazati i objasniti dijelove Zakona o autorskom pravu i srodnim pravima Republike Hrvatske te Zakona o radu koji se posebice odnose na autorska djela stvorena u radnom odnosu. Krajnji cilj ovoga rada je naglasiti određene zakonske klauzule koje bi trebale biti preciznije određene novim zakonom o autorskom i srodnim pravima, a koji bi se u Republici Hrvatskoj trebao izglasati 2021. godine, u skladu s Direktivom o autorskom i srodnim pravima na jedinstvenom digitalnom tržištu Europske unije iz lipnja 2019. godine koju su zakonodavci zemalja članica unije, pa tako i Hrvatske, dužni implementirati u svoje zakonodavstvo do kraja lipnja 2021. godine. Ako se određene klauzule preciznije ne odrede, za očekivati je da će u budućnosti sudovi u Republici Hrvatskoj biti preopterećeni tužbama vezanim za autorsko pravo. U svrhu postizanja gore spomenutog konzultirana je literatura, knjige i članci, eminentnih hrvatskih pravnih stručnjaka čiji je područje djelovanja baš autorsko pravo.
Abstract (english)
This paper explores and focuses on copyrights under an employment relationship in the Republic of Croatia. The purpose of this paper is to give a brief overview of the Croatian Copyright Law, as well as the articles that are included in the Labour Law which are specifically designed for copyrights under an employment relationship. The objective of this paper is to illustrate which legal clauses, relating to copyright law and laws of similar themes, need to be more exact in the new law which will come to pass in 2021. The new law has to be in accordance with European Union copyright legislation, which all EU countries are under obligation to implement in their own law systems by the end of June of 2021. Also, the goal of the paper is to point out parts of the Copyright Law which are not precisely designed, to prove that if they are not modified by implementing important articles in the new law, the Croatian law system will be disrupted and suffer by the consequent law suits connected to copyright issues. In the course of above mentioned, a detailed analysis of the articles in the current Copyright Law and Labour Law are given in this paper. In order to achieve the aforementioned, the subject was surveyed through literature written by the most eminent and influential Croatian law analyst.
